The course covers comprehensively all aspects of law, practice and procedures relating to patenting in India and internationally
Module 1- Evolution of IP Laws & Indian Patent Act
The first module takes the participants through the evolution of the concepts and principles of intellectual property in the backdrop of international trade and globalization. It also dwells on the impact of the international conventions and the WTO and TRIPS regime in the development of current IP policies, national legislations and global perspectives of the patent system. The module finally ends with an in-depth tour of the substantive provisions of Indian Patent Act as amended in 2005.
Module 2 – Procedural & Practical Issues of Patenting
This module is designed to train the participants in the procedures involved in prosecuting a patent. It begins with intensive sessions on ‘reading and writing patents’ involving prior act search and goes on to the study of the crucial drafting of claims and specifications.
Further special training is given to the students on patent filing procedures and the study and applicability of the relevant forms and fees to be paid. Module 2 also focuses on instructing students about opposition proceedings, which includes visits to the patent office and challenging mock exercises. This module closes after examining all aspects of infringement, revocation, surrender and enforcement.
Module 3- Commerce & Management of Patents
Deals with the commercial and management aspects of patenting and provides a through insight into the subject of technology transfer and patent licensing. These sessions exposes the participants to the necessary contractual elements of transfer of technology, know-how and confidential information and the mechanics of drafting license agreements including dispute resolutions and negotiations.
The latter part of the module dwells on the important issues of due diligence, audit, and valuation of IP and portfolio management. We also include special sessions on the emerging issues of taxation and insurances related to IP.
The module finally closes with a study of the impact of other intellectual properties and organizations on patenting, like Traditional Knowledge and Biodiversity and the role of customs and other organizations in enforcement of patent rights. |
